Terms of Sales
These general conditions of sale apply to all sales made on the opot.fr website, subject to the special conditions indicated in the presentation of the products.

ARTICLE 2: Essential characteristics of the products and services sold
The opot.fr website sells:
  ceramic objects suitable for food use
The customer declares to have read and accepted the general conditions of sale prior to placing his order. The validation of your order therefore constitutes acceptance of the general conditions of sale.

ARTICLE 3: Price
The prices of my products are indicated in euros all taxes included (TTC).
In the event of an order delivered in a country other than mainland France, the customer is the importer of the products he purchases. For all products shipped outside overseas communities or the European Union, the customer is solely responsible for declaring and paying any customs duty or other tax that may be payable in his country.
In the EU, delivery costs are included in the prices of products offered online.
Outside the EU, delivery costs are not included in the price. The order form indicates the amount of delivery costs before any order is placed.

ARTICLE 4: Product availability period
If the product is not immediately available, you will be notified of the lead time.

ARTICLE 5: Order
You have the possibility to order my products directly on my website or by phone.
You will receive an e-mail confirming your order at the e-mail address you provided when ordering.
Check the details and the total amount of your order. Correct any errors beforehand before any acceptance.
The transfer of ownership of the product will only take place upon full payment of your order.

ARTICLE 6: Delivery
I offer only one type of delivery, by carrier to the address indicated by the buyer.
Delivery times are indicative.

ARTICLE 8: Terms of payment
Several payment methods are accepted. As a customer, you have the option of paying by: PayPal / credit card (by PayPal) / bank transfer / cheque.
I accept payment by cheque. I only authorize cheques issued by a bank located in mainland France. Made payable to Marianne Finlayson send it to the address indicated on the site.
Eventually :
As soon as you place your order, I reserve your product for a period of 10 working days. In the absence of receipt of the cheque within the period indicated, I will be obliged to cancel your order. Your cheque will be returned to you immediately upon receipt. Payment is cashed upon receipt of the cheque.
I require full payment for the order.

ARTICLE 9: Right of withdrawal
In accordance with article L121-20 of the Consumer Code, you have a right of withdrawal to exercise within seven working days of receipt of the article. You neither have to justify reasons nor to pay penalties, apart from the cost of return;
Eventually :
The right of withdrawal does not apply for products made according to your specific indications and for personalized products.
Reship the product within the time frame mentioned above. Within the same period, inform me of the exercise of your right of withdrawal by email to: marianne@opot.fr.
The goods must be returned to the address indicated on the site, the return costs being at your expense.
In order for my returned product to be marketable again, you agree to return it to me in its original packaging and in perfect condition. The packaging can be opened and the article used as long as it is possible to sell it.


ARTICLE 10: Guarantee and right of return of the product (hidden defect or defect)
You benefit from the legal guarantee of conformity and therefore from an application of article L211-4 of the Consumer Code which provides that:
    “The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. "
    “He/she is also responsible for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to him/her by the contract or has been carried out under his/her responsibility. "
The warranty is applicable to my new products having a defective nature (lack of functionality, product unfit for the use that you can expect, absence of the characteristics presented online, partial or total malfunction of the product, failure of the product) and this, even in the absence of a contractual guarantee.
A lack of conformity can appear up to 6 months after the transaction. Its existence is presumed on the day the goods are delivered and you do not have to prove the existence of the lack of conformity.
In the event of a lack of conformity, I undertake to replace the product.
In the event of failure in the performance of my obligation or in the event of a major defect, I undertake to reimburse you for the full price paid or part of the price if you wish to keep the product.
The presumption of lack of conformity no longer applies if it appears after 6 months following the sale and before 2 years. You must provide proof of the defect of my product.
In the event of a hidden defect in your product, you benefit from the legal guarantee against hidden defects in articles 1641 to 1649 of the Civil Code. It applies to all my new products. This warranty applies when the defect renders the product unfit for use or when it reduces its use to such an extent that you would not have bought it or would have paid for it at a lower price. The guarantee against hidden defects only applies when the defect is prior to the sale. You have a period of 2 years from the discovery of the defect to act.
If there is a defect, I agree to replace your product or reimburse you as soon as possible.

ARTICLE 11: Conditions and deadlines for reimbursement
Product reimbursement is full. It is made by PayPal or check. as soon as possible and at the latest within 30 days from the date of exercise of the right of withdrawal.

ARTICLE 12: Consumer complaints
Any consumer complaint should be sent electronically to marianne@opot.fr.

ARTICLE 13: Intellectual property
All comments, images, illustrations on my site are exclusively reserved for me. Under intellectual property and copyright, any use is prohibited except for private use.
Without prior authorization, any reproduction of my site, whether partial or total, is strictly prohibited.

ARTICLE 14: Liability
In accordance with article 1147 of the Civil Code, I assume full contractual liability towards you in the event of non-performance or poor performance of the contract concluded.
However, my contractual liability cannot be engaged in the situations mentioned below:
    case of force majeure;
    foreign fact which cannot be imputable to me.
Eventually :
    The images on my site have no contractual value. They cannot therefore engage my responsibility.

ARTICLE 15: Personal data
Certain information relating to the customer will be transmitted to the seller (namely name, first name, address, postal code and telephone number) in order to allow the processing and delivery of the products ordered.
The site provides the customer with the collection and processing of personal information with respect for privacy in accordance with law n ° 78-17 of January 6, 1978 relating to data, files and freedoms.
Under articles 39 and 40 of the law dated January 6, 1978, the customer has the right to access, rectify, delete and oppose his personal data. The customer exercises this right via:

ARTICLE 16: Competent jurisdiction and applicable law
In the event of a dispute between the consumer customer and my company, the applicable law is French law.
The French courts have sole jurisdiction to settle the dispute.
